  • Incoterms

    Incoterms precisely define the transport cost distribution between seller and buyer, and the place for the transfer of risk from the seller to the buyer. They also determine which party has to obtain the documents and from when on the the responsibility for damage and loss shall pass from the seller to the buyer. Incoterms are only applicable if they have been expressly and contractually agreed. Specific contractual provisions and agreements have precedence over Incoterms. Our descriptions and explanations are only meant to provide an initial overview. It is recommended to check the specific contents and clauses prior to contractual use. 

    EXW – Ex works (...named place)

    (Ex works) - Group E

    EXW is the simplest clause. The exporter shall make the agreed goods available for collection at his premises at the agreed date and time, and has thus fulfilled the obligations resulting from the sales contract. From here on all transport costs, risks and fees (e.g. tolls) are to be borne by the purchaser.

    FCA – Free carrier (...named place)

    The seller has to clear the goods for export and deliver them to the named place. Up to this place, he bears all costs and risks connected with the transport. Should the agreed place be on the seller's premises, he has to load the goods as well.

    Incoterms FCA

    FAS - Free alongside ship (...named port of shipment)

    (Free alongside ship) - Group F
    (main transport paid by the purchaser)


    The seller shall deliver the goods alongside the vessel at the named port of shipment. From this place, all transport costs and risks are transferred to the purchaser. The seller has to clear the goods for export.

    FOB - Free on board (...named port of shipment)

    (main transport paid by the purchaser)

     

    The transfer of transport costs and risk takes place on board of the vessel at the named port of shipment.

    Incoterms FOB

    CFR - Cost and Freight (...named port of destination)

    (Cost and Freight) - Group C
    (main transport paid by the seller)


    The seller shall bear the transport costs up to the port of destination. However, the transfer of risks takes place on board of the vessel (as with FOB). The seller has to clear the goods for export.

    Incoterms CFR

    CIF - Cost, insurance and Freight (...designate port of destination)

    (Cost, insurance and Freight) - Group C
    (main transport paid by the seller)

     

    The seller shall bear the transport costs up to the port of destination and has to clear the goods for export. He is obliged to take out an insurance covering the riks to be borne by him and to carry the costs for said insurance.

    Incoterms CIF

    CPT - Carriage paid to (...named place of destination)

    (Carriage paid to) - Group C
    (main transport paid by the seller)


    The seller shall bear the transport costs up to the contractually named place of destination. The risk of transport is passed on to the purchaser, upon taking over of the goods by the first carrier. The seller has to clear the goods for export.

    Incoterms CPT

    CIP - Carriage and insurance paid to (...named place of destination)

    (Carriage and insurance paid to) - Group C
    (main transport paid by the seller)


    CIP closely corresponds to CPT, however the purchaser has to take out a transport insurance at his expense (minimum coverage).

    Incoterms CIP

    DAT – Delivered at Terminal (... named terminal)

    (Named terminal) - Group D


    The seller shall place the goods at disposal at the named (designated) termial (e.g. quay, container yard, rail or air freight terminal) and has to bear the transport costs and risks up to this terminal. He has to clear the goods for export.

    Incoterms DAT

    DAP - Delivered at place, duty unpaid (...named place of destination)

    (Delivered at place) - Group D


    The goods are being delivered, duties unpaid and without unloading, to the named point of destination, at the expense of the purchaser. The purchaser carries all transport risks up to this place. From there on, costs and transport risks shall pass to the purchaser. The named place should be designated as precisely as possible.

    DDP - Delivered duty paid (...named place of destination) Container

    (Delivered duty paid) - Group F
    (arrival clause)

     

    The purchaser shall carry all transport costs and risks up to the named place of destination. He shall also bear the costs for import clearance and applicable import duties of the country of destination.
